These Terms of Service (“Terms”) are a legal agreement between you and MiserSavings Inc. (“mi$er,” “we,” “us,” or “our”) that governs your use of the mi$er mobile app, our website, and any related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Services.
PLEASE READ CAREFULLY. These Terms include a mandatory arbitration provision and class-action waiver. You give up the right to sue us in court or participate in class actions, except as described in Section 16. You may opt out of arbitration within 30 days of creating your account.
mi$er is a financial technology application, not a bank. We provide the app, the goal-setting experience, the skip-logging tools, and the deposit initiation layer. We are not a bank, broker-dealer, or custodian.
mi$er helps you automate saving by initiating ACH transfers between your own accounts — from your linked checking account to your own savings account — both of which you hold and control at your own bank(s). MiserSavings never holds, pools, or commingles your funds on its balance sheet at any point. Your money is always in your own accounts, in your own name.
To use mi$er, you must:
You create your mi$er account through our authentication provider, Clerk, using an email address or phone number. You are responsible for:
One person, one account. You may not share your account or transfer it to anyone else.
Before you can initiate transfers, federal law requires us to verify your identity. We will collect your legal name, date of birth, residential address, and Social Security Number, and we may ask you to upload a photo of a government-issued ID. You authorize us to verify this information against credit bureaus, public records, and fraud databases.
If we cannot verify your identity, you will not be able to use the transfer features of the app.
mi$er connects to two of your own bank accounts via Stripe Financial Connections: your linked checking account (the source) and your linked savings account (the destination). Both accounts are yours — held at your bank, in your name. mi$er never receives or holds your funds. Money movement between your own accounts is initiated by our ACH processing partner (disclosed in-app at the time you authorize a transfer).
When you log a skip, mi$er records a commitment to save that amount. Every Sunday, your week’s skips are batched into a single ACH transfer from your linked checking account directly to your linked savings account. You may also add money at any time via the “+ Add Money” feature, which triggers an immediate ACH transfer between your same two accounts.
By using the app you pre-authorize mi$er to initiate these ACH debits from your checking account on your behalf. We will not overdraw your account.
If a transfer fails (for example, insufficient funds), we will notify you in-app and may pause skip-logging until resolved.
Because your savings are already in your own savings account at your bank, your money is always directly accessible through your bank. Withdrawals are free. There are no lock-up periods — your money is always yours.
If your account becomes dormant under applicable state unclaimed property law, we will use reasonable efforts to contact you before any action is taken.
Withdrawals are free. mi$er charges a service fee on each weekly Sunday batch — 3.99% of the batch total, capped at $4.99 per batch. This service fee covers the cost of the bank transfer and the operation of the service. We will provide at least 30 days’ advance notice before introducing or changing any fee. Subscriptions and overdraft charges do not exist on mi$er and never will. See the in-app Error Resolution Notice for your rights regarding unauthorized or erroneous electronic fund transfers.

mi$er includes an AI coaching feature that provides motivational messages and habit insights. These messages are informational and motivational only. They do not constitute financial, investment, legal, or professional advice of any kind.
By creating an account, you agree to receive all disclosures, agreements, notices, and other communications from us electronically — through the mi$er app, email, or SMS.
You have the right, consistent with the federal Electronic Fund Transfer Act (Regulation E), to:

mi$er, the mi$er logo, and all associated designs, code, copy, and branding are owned by MiserSavings Inc. or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. We reserve all rights not expressly granted.
Anything you submit through the Services (feedback, feature requests, suggestions) may be used by us without obligation or compensation to you.
The Services rely on third-party providers, including Stripe Financial Connections (bank account linking and identity verification), our ACH processing partner (transfer initiation between your own accounts; disclosed in-app before any transfer), Supabase (authentication and application data hosting), Resend (transactional email delivery), Anthropic (AI Coach inference — see §7 and the Privacy Policy §7 for what is and isn’t sent), Sentry (crash and error reporting), and Apple and Google (app distribution). Your use of those services is also subject to their respective terms and policies. We are not responsible for third-party failures outside our reasonable control.
We may suspend or close your account at any time, with or without notice, if we believe that:
You may close your account at any time from the Profile tab in the app, or by emailing [email protected]. Because your savings are in your own bank account, closing your mi$er account does not affect the funds in your savings account. Sections of these Terms that by their nature should survive termination will survive — including disclaimers, liability limits, arbitration, and intellectual property.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law — for example, consumer rights under Regulation E.
You agree to defend, indemnify, and hold harmless MiserSavings Inc. and its affiliates, officers, directors, employees, and service providers from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any content or information you submit.
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services, whether based in contract, tort, statute, fraud, or any other legal theory, will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration shall be Travis County, Texas. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.
You and mi$er each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action. Claims may only be brought in your individual capacity.
Opt-out: you may opt out of this arbitration provision by emailing [email protected] with the subject line “Arbitration Opt-Out” within 30 days of creating your mi$er account. The email must include your full name and the email address on your account. Opting out will not affect any other part of these Terms.
Small-claims exception: either party may bring an individual action in small-claims court if it qualifies.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Except for matters subject to arbitration under Section 16, the state and federal courts located in Travis County, Texas will have exclusive jurisdiction over any dispute. You and mi$er each consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top and, for material changes, we will notify you by email or an in-app notice at least 14 days before they take effect. Your continued use of the Services after a change means you accept the updated Terms. If you do not agree, you must close your account before the changes take effect.
